AR Sports Group LTD Terms & Conditions Statement

1. Introduction
1.1 These Terms and Conditions (“Terms”) govern the provision of sports coaching and related services (“Services”) by AR Sports Group Ltd (“ARSG”, “we”, “us”, or “our”) to schools (“Client” or “you”).
1.2 By engaging our Services, you agree to be bound by these Terms.


2. Scope of Services
2.1 Services include PE cover, after-school clubs, behaviour-led coaching, CPD for teachers, co-teaching, pastoral mentoring, and other bespoke services agreed in writing.
2.2 All Services will be delivered in accordance with the ARSG curriculum and agreed schedules.


3. Engagement and Agreement
3.1 Services are requested and confirmed via website booking, email, phone, or formal agreement/SLA.
3.2 Unless otherwise agreed, Services will be assigned long-term to specific ARSG Staff. Rotation will only occur when necessary, and every effort will be made to avoid it.


4. Client Obligations
4.1 The Client shall provide a safe, suitable environment and all necessary facilities for delivery of Services.
4.2 The Client agrees to cooperate with ARSG on safeguarding policies and provide relevant guidance to Staff.
4.3 Where applicable, the Client shall provide parking and access for ARSG Staff.

4.4 If the delivery environment becomes unavailable or unsafe (e.g., due to weather or building closures), the Client remains liable for the session unless cancellation terms are met, or ARSG agrees to an alternative arrangement.


5. Fees, Payment and Cancellation
5.1 Fees shall be as set out in the quotation or invoice and payable within 30 days of invoice date unless otherwise agreed.
5.2 Payment methods accepted include bank transfer, card, and Stripe.
5.3 Cancellation Policy:

  • Cancellation more than 60 days before service start: full refund or credit at ARSG’s discretion.
  • Cancellation 30-60 days before start: 50% fee applies.
  • Cancellation less than 30 days before start: full fee applies.

5.4 Urgent Bookings: For bookings requested within 14 days of service start, an admin fee of up to £100 may apply, subject to ARSG availability and complexity.

5.5 Interest on Late Payments: ARSG reserves the right to charge statutory interest (currently 8% above the Bank of England base rate) plus a fixed late payment fee as per the Late Payment of Commercial Debts (Interest) Act 1998.


6. Staff Recruitment Fee
6.1 If the Client, or any organisation connected to the Client, employs or engages any ARSG Staff member within 12 months after the last service date, a recruitment fee applies.
6.2 Recruitment Fee:

  • £2,000 plus VAT for UK-based hires.
  • £3,000 plus VAT for international hires.
  • 15% of the Staff member’s gross annual salary or contracted value (whichever is higher).

6.3 The Client must notify ARSG in writing within 14 days of employment or engagement.
6.4 Failure to notify will incur a penalty of 20% of the recruitment fee.
6.5 This clause applies to direct or indirect engagements, including via third parties.


7. Staff and Safeguarding
7.1 All ARSG Staff hold valid DBS checks, qualifications, and training relevant to their role.
7.2 ARSG maintains responsibility for Staff conduct and safeguarding throughout service delivery.
7.3 Staff will comply with both ARSG and Client safeguarding policies.

7.4 We work only with children aged 16 and under. ARSG staff members may deliver sessions independently, without a school staff member present. All ARSG personnel are fully vetted, DBS-checked, and trained in safeguarding procedures. The Client must ensure that:

a) ARSG is informed of any safeguarding risks or concerns relevant to the pupils involved;

b) there is a designated safeguarding lead (DSL) at the school available to liaise with ARSG during sessions; and

c) ARSG is notified immediately of any safeguarding incidents, concerns, or allegations that arise during or after our delivery.


Both ARSG and the Client are jointly responsible for maintaining a safe environment in line with statutory safeguarding obligations.


8. Liability and Insurance
8.1 ARSG maintains appropriate public liability and professional indemnity insurance.
8.2 ARSG’s liability for any claim shall be limited to the fees paid for the relevant Services.
8.3 The Client agrees to indemnify ARSG against any loss or damage arising from Client negligence.


9. Data Protection
9.1 ARSG complies with GDPR and handles personal data responsibly.
9.2 Client data will only be used for service provision and marketing communications with consent.

9.3 We do not directly collect children’s data unless required under specific agreement or safeguarding protocol.


10. Intellectual Property
10.1 ARSG retains all intellectual property rights in curriculum content, materials, and resources.
10.2 The Client may only use ARSG materials for agreed Services and may not reproduce or distribute without permission.


11. Force Majeure
11.1 Neither party shall be liable for delays or failure to perform due to causes beyond reasonable control, including but not limited to acts of God, government restrictions, strikes, or pandemics.
11.2 In such events, both parties will agree on rescheduling or alternative arrangements.


12. Notices and Communications
12.1 All notices under these Terms shall be in writing and sent by email or recorded delivery to the addresses provided.
12.2 Notices are deemed received 2 business days after sending.


13. Severability
13.1 If any provision is found unenforceable, the remainder shall remain in full force.


14. Governing Law and Jurisdiction
14.1 These Terms shall be governed by and construed under the laws of England and Wales.
14.2 The parties submit to the exclusive jurisdiction of the English courts.
